Service Terms and Conditions
General Terms
- No Call-Out Charge: There is no charge for call-outs; however, service rates apply as quoted over the phone upon the engineer’s arrival.
Fixed Price Work
- Validity of Estimate: Estimates are valid for 30 days from the date of the written quote. Prices may be reviewed after this period to reflect changes in material or fuel costs.
- Scope of Work: The quotation covers only the listed works. Any discrepancies between the client’s scope and the listed works must be reported, and costings will be reviewed and amended accordingly.
- Market Conditions: CM Trade Solutions Ltd reserves the right to withdraw any quotations if market conditions change, affecting material costs, plant hire costs, or material availability.
- Parking: Customers must arrange parking for our engineers. Any parking tickets received during the work will be added to the final invoice.
Engineer Access
Our engineers will take all reasonable precautions to avoid mess while working, including the use of protective coverings and removing shoes when necessary. However, due to the nature of the work, there may be instances where this is not possible.
Invoices and Payment
- Deposit: A 50% deposit is payable immediately upon agreement to carry out any estimated or pre-booked work. We reserve the right to request full payment in advance at our discretion.
- Payment Terms: Payment is due upon the completion of the work and the engineer’s last day on-site. Reports, CCTV footage, and the 10-year guarantee will only be sent once full payment is received.
- Waste disposal arrangements, including the removal of any site waste, will be completed once the engineer has finished the work if it can fit in the van, or as soon as possible if excess waste requires merchant collection. Payment cannot be withheld upon completion of the work if site waste is not collected on the engineer’s last day, as delays may occur due to merchant availability and schedules, which are beyond our control.
- Late Payment: CM Trade Solutions Ltd reserves the right to charge interest on any unpaid balance beyond the due date at a weekly rate of 5% until full payment is received.
- Third-Party Instructions: If acting on behalf of a third party, you must inform us and provide invoicing details at least one week before the work begins. Failure to do so will result in the individual instructing the works being held responsible for any costs incurred.
- Debt Recovery: In the event of non-payment, we may engage a debt collection agency to recover the outstanding amount. The customer will be responsible for all costs incurred, including agency fees and legal expenses. Failure to pay may result in a County Court Judgment (CCJ) against the customer.
Cancellation
Access and Interruptions: We assume unrestricted access and no interruptions from other works on the premises. If our work must be aborted due to circumstances beyond our control, an abortion fee of at least 80% of the total job value plus VAT will apply.
Guarantee
10-Year Guarantee: We provide a 10-year guarantee on all foul system remedial works, effective from the date of completion. This guarantee covers the property for any failure of the works carried out by CM Trade Solutions Ltd within the area of works.
Sub-Contracting
- Sub-Contractors: We may subcontract any or all of our services, ensuring that all subcontractors are reasonably skilled in relevant practices.
- Second Man Labour Surcharge: Additional charges for a second skilled labourer may apply at the engineers discretion if the engineer deems extra assistance is essential to safely and efficiently complete the job.
High-Pressure Jetting
- Quotations for high-pressure jetting cover the use of our mobile units operating at 8 gallons per minute at 3000 psi.
- Additional charges apply for tanking units or extra jetting hose.
- Water Supply: We assume access to a strong water supply within 30 metres of all working areas at no cost. Fire hydrants are excluded unless a licence is provided.
Accessible Drainage
Drainage points must be accessible without disturbing the ground, cutting vegetation, cleaning pipework, moving items, or using additional equipment. Welfare facilities must be available on site for our employees.
CCTV Surveys
- Manhole Access: Manholes must be accessible on arrival; otherwise, they will not be surveyed.
- Survey Conditions: The quotation is based on available information. Any unforeseen changes in site conditions resulting in extra costs will be chargeable.
- Report Availability: The CCTV Survey report, footage, and findings will be provided 5–7 business days after completion of works and once full payment is received. These documents will not be provided prior to payment.
- Damage and Liability: If we need to create access to a manhole by excavation, we are not liable for any damage caused. A quotation for reinstatement will be provided.
- Scope of Survey: The CCTV Survey report comments are confined to the terms outlined and are not a structural survey.
Waste Disposal
- Site Waste: Site waste will be removed once the engineer has completed the work if it can fit in the engineer’s van. If there is excess site waste, it will be collected by a merchant. While we aim to arrange collection on the engineer’s last day on-site, delays may occur due to merchant availability and collection schedules, which are beyond our control.
- Payment cannot be withheld by the customer upon completion of the work if the site waste is not collected on the day of the engineer’s last visit. We assure the customer that all waste will be collected as soon as possible in line with merchant schedules.
Events Beyond Control
Uncontrollable Events: Neither party is liable for any failure or delay in performing obligations due to causes beyond their control, including power failure, industrial action, civil unrest, natural disasters, acts of terrorism or war, governmental action, or other events beyond control.
